For the 2004 presidential election, JibJab created a Flash movie entitled This Land, which featured a parody of Woody Guthrie's song "This Land is Your Land", sung by animated caricatures of George W. Bush and John Kerry.
JibJab and Ludlow Music reached a settlement after JibJab's attorneys unearthed evidence that the song had passed into the public domain in 1973.
Jibjab introduced a new feature which allows members (who can sign up for free) to compile and view written, video, or photo "jokes" and store them in their own "jokebox".

JibJab responded with a lawsuit in California federal court seeking a ruling that the film's use of the Guthrie tune was protected under fair use.
LiCalsi also said the JibJab movie does not technically classify as a parody of "This Land." In order to qualify legally as a parody of the song, LiCalsi said, the new material must comment on or criticize the ideas represented by the original property.
JibJab's lone server was at one point crushed by the torrent of activity, according to the company.

But while about 25 million viewers have been clogging JibJab to chuckle at the film's South Park-like Flash animation and juvenile insults (Bush labels Kerry a "liberal sissy," and Kerry responds by calling Bush a "right-wing nut job"), the Spiridellises aren't exactly laughing their way back to the drawing board.
JibJab Media, the proper name of the Spiridellises' company, never got permission to use Guthrie's song in This Land, and Ludlow Music is telling them to pull down the short.
LiCalsi said his client wants to resolve the dispute without filing a lawsuit against JibJab, but if it came down to a courtroom appearance, he would argue the Spiridellises used, without permission, too much of the music and lyrics of the original song in their short.

But in "This Land" and "Good to Be in D.C.," the musical parody cartoons that made brothers Gregg and Evan Spiridellis and their company kings of viral video, JibJab was mocking Bush, Democratic rival John Kerry and Washington, D.C. culture.
To be sure, having him miss a zero in the year's name is a barb, but it's the same dim-intellect joke Bush is smart enough to make about himself.
He is allowed to detail events that took place on his watch, but he is never stuck with responsibility for unsuccessful, incomplete or misguided responses to those events.

But in a bizarre twist, JibJab's lawyers discovered that anyone may record their own version of the song -- because the copyright on the words and music have expired, they said.

The Ludlow Music vs. JibJab case ended not because of any of the above arguments, but because the EFF discovered that the copyright on the Woody's music was never renewed in 1973 and thus had fallen into public domain.
The original JibJab clips were mocking the president; the clips in the song were used to mock the president.
The JibJab lawsuit was also based on the fact that the copyright for This Land is Your Land had expired and Ludlow Music had not renewed the copyright in a timely manner therefore JibJab was permitted to use the song since it had been considered legally to be in the public domain.

I must say, even though several commentators have agreed with me that the JibJab video is a satire, including Lawrence Lessig, I am having doubts about my original position based on the history of the song that interested bloggers and commentors have turned up.
Ultimately, because of my own suspicions about the post hoc reasoning I am left wondering if the JibJab guys actually used "This Land is our Land" because of it's history and meaning or just because it is a familiar tune with a refrain that worked well for their video...period.
To suggests the work is a parody one must take the position that the Jib Jab team knew the history and meaning of the song when making their video, even if that knowledge was some sort of background psychology at work in their heads at the time.

Where Guthrie's song is one of unity, JibJab's version both mocks and ultimately supports that ideal.
In a year in which the red/blue divide is frequently debated, Guthrie's call for unity would seem to be ripe for this sort of parody.
