Cummins insists that a more thorough assessment[?] of the students academic language abilities be performed before moving the student out of a 'sheltered' language development environment.

I have elaborated on essentially the same point in many publications (Cummins, 1979, 1981, 1982, 1986, 1996) drawing on John Ogbu's (1978) initial distinction between "caste" and "immigrant" minorities and attempting to work out how status and power differentials in the wider society are played out in the interactions between educators and students in school.
I have consistently argued (e.g., Cummins, 1979) that linguistic factors cannot be considered in isolation from the social context and Rossell and Baker's inability or unwillingness to acknowledge this is extremely surprising.

 Jim Cummins: Empowering Minority Students
The converse of this is that minority students will succeed educationally to the extent that the patterns of interaction in schools reverse those that prevail in the society at large.
The inclusion of instruction as a central dimension of the framework derives from the fact that genuine inclusion of students' non-school experiences, their community's culture, into the school program requires that educators abandon assumptions about teaching that focus primarily on transmission of pre-determined knowledge and skills.
The change process, however, will inevitably involve a consciousness-raising on the part of the community and at least some educators and will represent a challenge to the status quo that is likely to be strongly resisted by the dominant group.

Bilingual programs for minority and majority language students have been successfully implemented in countries around the world.
As documented in a recent volume by Cummins and Corson that documented programs in more than 30 countries, students educated for part of the day through a minority language do not suffer adverse consequences in the development of academic skills in the majority language.
Thus, if the English-only student performed at the 26th percentile at the end of those two years, the bilingual student would be at the 34th percentile.
