At the time of her jobseeker's allowance claim on 7 April 1998 she had been working as a supply teacher on a day to day basis in a primary school in Middlesborough, covering for a permanent teacher who was then on maternity leave.
The conditions of employment applicable to her and other teachers engaged on a similar basis by the education authority were in evidence before the tribunal, and make it clear that the legal employment relationship of such teachers is precarious in the extreme.
Her own jobseeker's agreement and jobseeker's allowance claim form had made it clear that her work was as a primary school teacher and this was the only form of employment she was looking for.

In that case the claimant had become pregnant and it was argued that she had suffered discrimination in the way that jobseekers' allowance operated.
The main issue was whether article 3 of the Directive applied to income-based jobseekers' allowance and turned on the question of whether the statutory scheme for that allowance provided protection against the risk of unemployment.
But it seemed to his Lordship to be arguable that the linking of the entitlement to the additional amount of jobseekers' allowance to the entitlement to child benefit put men at a disability to women both practically and theoretically.

The Jobseekers Allowance, which comes into force in October, is very bad news - it halves the period for claiming benefit, cuts the benefit of about 95,000 claimants completely, reduces the benefit of another 250,000 and introduces a coercive labour market.
The Jobseekers Directive will enable ES staff to compel claimants to take action to 'improve their employability'.They can be told to 'follow up a specific job advertisement' or 'register with an employment agency' Claimants may also be required to 'take steps to present themselves acceptably to employers', in the words of the JSA White Paper.
