We further note that Wardell does not contend on appeal that the district court should have provided him with an opportunity to amend his complaint and Wardell did not file a motion to alter or amend the judgment under Rule 59(e) or for relief from the judgment under Rule 60(b) after his complaint was dismissed.
Wardell is hereby warned that if he accrues one more strike, he will be precluded from proceeding in forma pauperis in any further civil proceedings unless he is under "imminent danger of serious physical injury." 28 U.S.C. § 1915(g).

 04-1034 -- Wardell v. Neal -- 11/03/2004
The district court's resolution of Wardell's claims is not reasonably subject to debate and the claims are not adequate to deserve further proceedings.
Although Wardell argues that he was unable to timely respond to the district court's order requesting the parties to supplement the record with evidence regarding statutory tolling of the one-year limitations period, it is clear from the district court's order that Respondents provided the court with the documentation necessary to resolve the issue.
Although Wardell is now incarcerated in a federal prison pursuant to a pre-trial detention order, at the time he commenced this § 2241 proceeding he was a state prisoner.
