Bailey defended Guerard and perceived the case as a means to publicize the Klan as a corporation engaged in unlawful business (see letter of Dec. 18, 1922, to Harry Dougherty).
Bailey was particularly outspoken during 1937-1938 on governmental policy and attitudes toward business, and there is considerable constituent mail related to his views.
Bailey was an outspoken critic of governmental attitudes toward spending and pump priming and believed that government should encourage private enterprise.

Josiah Bailey co-authored the Conservative Manifesto, a plan for national economic recovery during the Great Depression.
In 1937, U.S. Senator Josiah Bailey of North Carolina was concerned that President Franklin Delano Roosevelt and his New Deal programs were leading America and North Carolina down the road to collectivism.
Bailey also wanted to remind FDR that bi-partisan opposition to further collectivization was possible.

Admittedly, Bailey was not opposed entirely to government intervention in the economy, but the "reluctant New Dealer" believed government growth should have limitations and considered much of the New Deal intervention to be temporary.
Although Bailey’s opposition to the New Deal reflected the anti-spending sentiments of many Senators and many businessmen, the short-term and long-term effect of the Conservative Manifesto are debatable, for since the 1930s national government has increasingly intervened in economic affairs and eroded individual liberty.
Bailey continued battling those who extinguished "private investment and initiative"; he cast the only vote, to name one example, against the expansion of the Relief Appropriations Bill that provided an extra $250 million for the Works Progress Administration (Moore, Josiah Bailey, 159—76).

Bailey wanted to sell the paper for $16,000 to her son, Josiah William Bailey, who had edited the paper during his father's declining health.
About the turn of the 20th century, the decision was made to form a stock company to own the paper; the stock company was incorporated in 1906 and continued until 1938 when the Convention voted to buy the paper and all its assets, which included a handsome building on Hargett Street in downtown Raleigh.
