Jury - Wikipedia, the free encyclopedia
The jurors hear the cases presented by both the defense and prosecution, and in some jurisdictions a summing-up from the judge.
The most common exclusions are for people whose job in some way precludes them (for instance, teachers, doctors, firefighters, people who themselves work in the criminal justice system), are caring for young children, have an interest in the case, or who have health problems or serious criminal records.
Selected jurors are generally subjected to a system of examination whereby both the prosecution (or plaintiff, in a civil case) and defense can object to a juror.

Jurors should clearly understand that being eliminated from the jury panel by a peremptory challenge is no reflection upon their ability or integrity.
Therefore, it is wise for jurors not to even attempt to make up their mind on the facts of a case until all the evidence has been presented to them, and they have been instructed on the law applicable to the case.
Jurors must not talk about the case with others not on the jury, even their spouses or families and must not read about the case in the newspapers.

The term “actual bias” means the juror has a state of mind that would interfere with his or her ability to try the issue impartially and without prejudice to the substantial rights of a party.
Where a juror has an opinion upon the merits of the case, perhaps from what he or she may have heard or read, that opinion will constitute “actual bias” only when all of the circumstances indicate that the juror cannot disregard his or her own opinion and try the issue impartially.

To differentiate this movie from the earlier one, The Juror (based on the best-selling novel by George Dawes Green) has expanded beyond the trial, resulting in an increasingly-ridiculous series of plot twists that climax in a crumbling temple deep in the heart of a Guatemalan jungle.

Dozing juror fails to bring new trial - The Honolulu Advertiser
Chief Justice Ronald Moon, who wrote the majority decision, said the juror breached his duty of paying attention and was guilty of juror misconduct, but not all misconduct by a juror should result in a mistrial.
The majority opinion said it agreed with the prosecution that the misconduct was "harmless beyond a reasonable doubt." The prosecution had contended the juror did not sleep during testimony and the judge's instructions on the law and what the juror missed was not significant.
He said the majority was essentially substituting its judgment for that of the trial judge who heard the entire case, questioned and evaluated the juror and concluded that the defendant was entitled to a new trial.

THE PEOPLE &C., RESPONDENT, v. KENNETH PAGE, APPELLANT.
Substitution of the alternate juror in the first instance was prohibited by CPL 270.35 and the State Constitution absent written, signed consent by the defendant.
Defendant's motion was denied by Supreme Court, which held that substitution of the ailing juror without a written waiver did not invalidate the conviction because defendant insisted upon replacing the ill juror, and, after being questioned in open court, agreed to seating the alternate.
Despite the requirement in the Criminal Procedure Law of written consent by a defendant to the substitution of an already sworn juror after deliberation has commenced, on this record, there was an implicit waiver by defendant of his constitutional right requiring that he sign a statement consenting to the seating of the alternate juror.
