Truth commissions move us from justice to "future-oriented societal moral considerations." They promote "healing." They avoid vengeance and bring us "justice as recognition" and "restorative justice." I do not find these poetic renditions very powerful, while the realist defenses are quite persuasive.
Though she argues that truth commissions "are not just second-best responses," Minow herself acknowledges that even the best defenses of truth commissions "cannot deny the legitimacy of a demand for punishment," and she is right.
Doing justice during a transition from dictatorship to democracy requires an exceptional grasp of the particular society and its history, as well as a careful balancing of realism about the current correlation of forces against the desire for the punishment of wrongdoers from the ancien régime.

Justice and Truth (in Romanian Dreptate şi Adevăr, or D.A. for short) is a political alliance comprising two political parties in Romania: the centre-right liberal National Liberal Party (PNL) and the centrist reformist Democratic Party (PD).
As the political formation with the largest number of seats in parliament, the Justice and Truth Alliance is currently in government (in a coalition with the Democratic Union of Hungarians in Romania and the Conservative Party).
On October 25, 2004, the Justice and Truth alliance endorsed its co-chairman Călin Popescu-Tăriceanu (also the leader of the PNL) as its candidate in the 2004 Romanian legislative election.

And while truth commissions can elicit broader historical truths than trials, the value of this will depend on whether the crimes were carried out in a manner designed to evade responsibility (say, by disappearances or death squads) or whether, as in Bosnia, Rwanda and Sierra Leone, they were incited and practiced in the open.

I have wondered from time to time, as I watch the American justice system in action, whether we are truly concerned with facts - truth if you will - so much as we are in a process.
We'd like to say "truth," but the fact is that we don't actually know the truth.
We use qualified prosecutors, defense attorneys and judges, but those who decide what the truth is in each case are primarily distinguished by their ignorance.
