The legislation ratifies the Agreement with Respect to Kanesatake Governance of the Interim Land Base between the federal government and the Mohawks of Kanesatake(1) that was concluded on 21 June 2000and signed on 21 December 2000.
The uncertain status of Kanesatake lands was underscored in a 1998 decision of the Quebec Court of Appeal ruling that municipal zoning and construction by-laws applied to at least the Mohawk properties at issue which were not, in the Court’s view, “public property.”(21)
Clause 2(1) defines “Kanesatake Mohawk neighbouring lands” (neighbouring lands) as lands located in the sectors of Schedule B of the Agreement, in the area known as the “Village of Oka”(32) (Schedule C of the Agreement relating to harmonization defines these as “adjacent lands”).

A Quebec highway near Oka was closed by trees felled by angry Mohawk protesters, who also built a barricade of blazing logs outside the police barracks, hurling rocks and debris at police seeking to flee the brick structure.

QUEBEC CITY - The Quebec government has appointed an independent negotiator to help broker a deal between the community of Kanesatake and ousted grand chief James Gabriel.
The Quebec government says it wants to ensure Gabriel's safe return to his community, and native affairs minister Benoit Pelletier said that the appointment of mediator Jean Bazin will help improve communication between Gabriel and the people of Kanesetake.
John Harding, one of three chiefs on the Mohawk council opposed to Gabriel, said the appointment of Bazin is undemocratic.

The Kanesatake community learned that James Gabriel, was allowed to address and sit with the chiefs even though he was no longer the Grand Chief for Kanesatake.

The most famous of those incidents, the one that still resonates most with people on both sides of the issue, was the standoff in Oka, Quebec.
The Kanesatake (Pronounced Ga-nes-a-ta-ge: hard g sound) Mohawks had been ceded rights to a stand of pine trees and burial lands by the government of New France in 1717, and were to be held in trust for them by a Catholic Seminary.
In 1990 when the city council of Oka decided to clear the remaining stand of pine trees in order to expand a private members golf course (of which the mayor was a member) and build luxury condominiums, it was the final insult.
