The LaGrand case was a contentious case in the International Court of Justice, Germany vs. United States of America (1999 - 2001).
The LaGrands were German nationals, having been born in Germany and having moved with their mother to the United States at age 3; at no time did they become citizens of the United States.
Karl LaGrand was subsequently executed by the State of Arizona on February 24, 1999.

Among the claims raised in Walter LaGrand’s petition for a writ of habeas corpus was the claim that execution by lethal gas constituted cruel and unusual punishment under the Eighth Amendment to the United States Constitution.
The court concluded that Karl LaGrand’s failure to raise the lethal gas claim was excused because there was no legal or factual basis for the claim when he pursued his direct appeal in state court.
At the last moment, Karl LaGrand requested the use of lethal injection, which the State allowed, and the validity of the Ninth Circuit’s injunction was not tested.

 LaGrand Case
On 7 January 1982, Karl LaGrand and Walter LaGrand were arrested in the United States by law enforcement officers on suspicion of having been involved earlier the same day in an attempted armed bank robbery in Marana, Arizona, in the course of which the bank manager was murdered and another bank employee seriously injured.
On 15 January 1999, the Supreme Court of Arizona decided that Karl LaGrand was to be executed on 24 February 1999, and that Walter LaGrand was to be executed on 3 March 1999.
This is so because, prior to 1992, the LaGrands could not resort to the available remedies, since they were unaware of their rights due to failure of the United States authorities to comply with the requirements of the Vienna Convention; thereafter, the "procedural default" rule prevented them from seeking any remedy.

The LaGrands, condemned to death for killing Marana bank manager Kenneth Hartsock in 1982, hoped to escape execution by requesting the gas chamber so they could contend that it was cruel and unusual punishment.
The legal maneuver ultimately won Karl an extra five hours of life, but the U.S. Supreme Court lifted a lower court stay and he was executed Wednesday night.
