Kathy then fled to South Africa with Ben to live with her brother.

I don't get the reasoning behind killing Kathy off, it's a bit like Mark Fowler's death she is no longer in the show, so why bother making storylines about characters who are no longer in the show.
As for a court case, as Kathy was married to a South African who adopted her son then in real life the court case would be in South Africa not Walford.
They should bring back Kathy alive so that there could be a story between her, Phil and Grant, and the guy who adopted Ben could come into it, and Phil and Grant murder him to get custody.

I can't believe they are going to kill Kathy Beale off screen just to have some boring plot about Ian vs Phil over custody of Ben.
I hate to admit when EastEnders gets it wrong as I'm such a big fan (as you might be able to gather from my username) but this idea is just totally absurd and has left me feeling cold to be honest.
Kathy is one of the original characters and she's a good character too, Gillian might not want to return now but there's a good chance she might one day so they should just leave the door open for her.
