The cross-appeal involves a claim by Globetrotter against Elan and Greer for infringement of the ’297 patent.
For the purposes of his state-law claims, Greer argues that Globetrotter engaged in bad faith, but he endeavors to show it only through attempts to demonstrate subjective bad faith.
In the district court, Greer made no effort to establish that the claims asserted by Globetrotter with respect to the ’369 or ’412 patents were objectively baseless, either because those patents were obviously invalid or plainly not infringed.
"Something Twisted", Tango Sierra's second album, produced by Kenny Greer (Tom Cochrane and Red Rider/The Roadhammers), is due to be released in March of 2007.
Hollis Brown of Tango Sierra said his group was hoping to record this fall or winter, but the September deadline that came with winning the $10,000 moved things up.
Producer Kenny Greer's schedule came into the timing; he is touring with the Roadhammers and Tom Cochrane, and recording and mixing for both.
Greer is a project engineer and satellite office manager for the Lafayette (LA) office.
In addition, he attended the University Of Mississippi Graduate School studying Geological Engineering.
Greer has over 9 years of experience in Construction Materials Testing projects ranging from a 2500 ft long earthen dam in Trenton, TN to drilled shaft/pier inspections on the new Mississippi River Bridge in Greenville, MS.
Following this training, Ken farmed in southern Saskatchewan in the summers and conducted research at the University of Saskatchewan in the winters on such topics as the agronomy of Winter Wheat, development of root systems, general plant nutrition and soil quality.
Ken is currently President of Western Ag Innovations Inc., a company that holds 7 worldwide patents on the award winning Plant Root Simulator (PRSTM) technology.
In only 9 years, PRS technology has grown to be the fourth largest soil testing/consulting service in North America.
As an active dancer, Ken practices for competitions, is involved in dance organizations and also has other dance websites.
Ken is excited about the rapid growth of this project and looks forward to what the future may hold.
As a dancer of 15 years, one common problem I noticed for myself and friends over the years was the frustration we all shared in finding an appropriate dance partner.
