Gilbert v. Gilbert v. Hanover Ins. Co.
Kevin endorsed the check on the condition that $2000 of the $5000 be placed in an escrow account while he and Beverly tried to resolve who was entitled to the proceeds.
Kevin also refused to endorse these checks because he believed that he and Beverly were entitled to a larger payment from Hanover, and that endorsing the checks would be construed as a waiver or settlement of their claim.
Retroactivity of the Amendment [¶17] Kevin contends that the amendment to the policy increasing coverage for loss of personal property from $52,000 to $62,400 is retroactive to the date of the original policy, prior to the fire, and that he generated an issue of material fact as to whether the amendment was retroactive.

It's hard to say what Kevin Gilbert would be doing today if he hadn't passed away in 1996.
One of the last projects he was working on was a rock opera called The Shaming of the True, a biting commentary on the music industry at large as seen through the eyes of an aspiring young rock musician named Johnny Virgil.
Kevin's long-time friend (and Spock's Beard drummer) Nick D'Virgilio and "a couple of other friends" took on the task of cataloging everything for Gilbert's estate.

More Than `The Piano Player' / Dumped by Sheryl Crow after propelling her to success, brilliant musician Kevin Gilbert ...
Gilbert was a prodigy musician from San Mateo who could play any instrument; colleagues invariably called him ``the most talented musician I ever met.'' To the rest of the world, though, his only real claim to fame lies in the credits to ``Tuesday Night Music Club,'' the 1993 debut album by Sheryl Crow.
Gilbert threw himself into other projects: helping Baerwald produce a solo album by Susannah Hoffs of the Bangles, working with Bottrell on an album by Linda Perry of 4 Non Blondes (the Tuesday night gang dubbed her ``the anti- Sheryl''), writing and recording scores for TV shows under a pseudonym.
Although Crow is reluctant to discuss Gilbert, she has been openly vocal in interviews about the rift over the album with the Tuesday Night Music Club.
