McClory is best known for the 1983 James Bond film Never Say Never Again, which was the result of a long legal battle between McClory and Ian Fleming (later United Artists/MGM) over the writing credits and later the film rights to Thunderball.
McClory started his film career as a film technician at Shepperton Studios, where he worked as an assistant to John Huston on films including The African Queen (1951) and Moulin Rouge (1952).
In 1976 McClory announced he was to produce an original James Bond film to be titled either Warhead, Warhead 8, or James Bond of the Secret Service, but the project immediately ran into more legal problems with the Broccoli family and was ultimately abandoned.

In December 1963 Fleming settled out of court with McClory at the behest of Ivar Bryce, who felt Fleming's health was being seriously affected by stress from the lawsuit (Fleming had already been victim to one heart attack and in 1964 would die from a second).
In the middle of the onslaught of lawsuits between Sony and MGM, Sony countersued MGM in 1998 attempting to claim that McClory was the co-author of the cinematic Bond and was owed fees from Danjaq and MGM for all past films.
This matter, which McClory calls "The Greatest Act of Piracy in the History of the Motion Picture Industry", was thrown out in 2000 by Judge Edward Rafeedie on the ground that McClory had waited too long to bring his claims.

McClory might be able to argue that EON incurred the delay by tying his hands and preventing him from getting his own Bond projects off the ground.

McClory has not sought so much to promote his own rights and films but to do so deliberately at the cost of Eon, broadsiding Cubby whenever he could.

Sony is claiming it has the legal right to the 007 franchise through its association with producer Kevin McClory, whose co-ownership of the Bond character stems from collaborations with Bond author Ian Fleming.
And because of his ownership of the Bond character, Sony said, McClory is owed some portion of the estimated $3 billion the franchise has generated.

Briefly outlining the 40-year history of this Bond litigation, the judge pointed out that there have been at least three major lawsuits involving McClory and the Bond rights, but that it was not until 1997 that McClory alleged he was the co-owner of the Bond character.
Back in 1997, Sony said it had purchased McClory's Bond rights and was going to use them to launch a competing Bond franchise.

Jack Whittingham’s widow and family remained unaware of this case, (and indeed, the book), as they had not been notified about the proceedings by Kevin McClory or told of the apology that had been directed to them, nor was any offer made to his widow for a share of the damages awarded.
Nonetheless, the apology in Court was made for the "distress suffered by Jack’s widow" and it was felt that Kevin should surely have paid a share of the damages he received to her, for the unjust and ill-founded attack on Jack.

On the 28th April 1976 Kevin McClory announced his intention to make 'James Bond of the Secret Service', later 'Warhead', based on the original 'Thunderball' storylines.
McClory had attracted Sean Connery - the two being involved in scripting, with Len Deighton.
McClory had also taken out an injunction to stop filming of 'The Spy Who Loved Me' after it was discovered it was to feature SPECTRE (which McClory was claiming he had co-created).
