The speaker of Parliament, Russell Kun claimed that Keke is not a Nauruan citizen.
Keke was also arrested along with David Adeang and Fabian Ribauw in April 2004 and charged with sedition after a protest at Nauru's airport, but the charges were soon dropped.
Keke was reelected to Parliament in October 2004, and retains his post as health minister.

The Speaker, Russell Kun, had been refusing to allow the Health Minister in the relatively new reformist Nauru Government, Dr Kieren Keke, from taking his seat on the grounds that he was ineligible to be a member because he was a citizen of both Nauru and Australia.
KIEREN KEKE: A few hours before the sitting of Parliament, the Speaker had written to me informing me that in his opinion I had ceased to be a Nauruan citizen and he had declared that I was no longer a Member of Parliament and my seat was vacant.
KIEREN KEKE: The President declared that a state of emergency exists in Nauru in terms of economic crisis and invoked powers under the Constitution which then allows government access to Treasury funds and allows us to continue operating government functions.
