In a May 2005 ruling, the Saga District Court found company employee Teruhiko Matsue not guilty of killing the three as the evidence submitted by prosecutors was "not sufficient enough to judge that the defendant is the true culprit beyond reasonable doubt." The prosecutors had demanded the death penalty for him.
The defense counsel discounted the discovery, saying the DNA is not sufficient for identification purposes, and contended that the prosecutors had concealed forensic evidence indicating the possibility of another culprit, such as the discovery of urine residue on a seat in Matsue's car that does not match that of any of the victims.
In November that year, Matsue submitted a written confession during questioning by the Saga prefectural police, but he later retracted it, leading the police at that time to give up establishing the case against him as a murder suspect due to insufficient evidence.

SAGA (Kyodo) The Saga District Court on Tuesday acquitted a 42-year-old man of killing three women in Kitagata, Saga Prefecture, between 1987 and 1989, citing a lack of evidence.
Their bodies were found in January 1989 in a mountainous forest near Kitagata.
Matsue was Yoshino's boyfriend, and he wrote the statement confessing to the murders when he was being detained by police in connection with a separate criminal investigation.
