Kleinwort Benson is one of the most distinguished international investment banks in the City of London, becoming part of the Dresdner Bank Group in 1995.

Brimming with generations of Kleinworts, Bensons, and the families with whom they married and formed partnerships, the book evokes their feuds and friendships, their successes and failures, set against the background of more than two hundred years of social and business history.

House of Lords - Kleinwort Benson Limited v. City of Glasgow District Council
Reliance by Kleinwort on this provision in the present case faces the obstacle that the money was here paid under a mistake of law and, as English law stands at present, money so paid is not generally recoverable in restitution.
It was the case of Glasgow that the English High Court had no jurisdiction over Kleinwort's claim because Glasgow was domiciled in Scotland and so, by virtue of Article 2, should have been sued in the Scottish courts.
Kleinwort however claimed that the English courts had jurisdiction by virtue of four provisions including Article 5(1) and 5(3)--the only two provisions now relied on by Kleinwort.

House of Lords - Kleinwort Benson LTD. v. Lincoln City Council
Kleinwort Benson LTD. v. Mayor etc. of the London ...
There is, as I understand it, no dispute that in order to recover the plaintiff has to have been labouring under the mistake at the date of payment and to have made the payment because of that mistake.
The question is whether the subsequent overruling of the 1930 Court of Appeal decision requires the court to hold that at the date of payment (1990) the law (contrary to what the plaintiff had been advised) was not the law established by the Court of Appeal decision of 1930.
However, your Lordships do have to decide whether, if at the trial such a settled view is proved to have existed, it would prevent Kleinworts from recovering the monies paid on the basis of monies paid under a mistake of law.
