Essentially, then, Koppers requested the district court to reconsider its earlier decision which had dismissed the claims pertaining to the 1960-65 policies on the grounds that INA was an indispensable party.
Koppers counters that this Court does have appellate jurisdiction as there was no appealable order concerning the dismissal of the 1960-65 policies until the district court certified this issue under Rule 54(b).
In response, Koppers asserts that the district court erred in determining that INA was an indispensable party under Rule 19(b) because INA is not, in fact, a necessary party under Rule 19(a).

Koppers Industries is trying to find a buyer for its 4-year-old Monessen coke plant, which employs about 200 workers.
Koppers disclosed in a recent government filing that it was considering the sale so it could get cash for the fuel tax credits generated by the Monessen plant.
Koppers said it received $25.8 million in tax credits from the plant over the last three years and could get as much as $10.4 million annually until the credits expire at the end of 2002.
