Exactly speaking, it insists that Kunashiri and Etorofu are not included in the Kuril Islands which were placed out of the sovereignty of Japan by the San-Francisco Peace Treaty signed in 1951.
Secondly the Kuril Islands are geographically on the chain of volcanos from Kunashiri to Shumushu.
Kunashiri and Etorofu are excluded of the Kuril Islands abandoned by Japan in the Peace Treaty of San Francisco.

Russia seized a Japanese fishing boat with five crew members off the disputed Kunashiri Island in northern Pacific on Thursday on suspicion of poaching, Japan Coast Guard officials said.
The Russian authority apparently took the boat to Kunashiri Island after finding unauthorized catches, including shrimps and rockfish known as "kinki," on the boat, the officials said.
The incident took place in waters a few kilometers off Kunashiri Island, one of the four disputed islands east of Hokkaido that also include the islands of Etorofu and Shikotan and the Habomai group of islets.

 Japan in Their Own Words
In March 2001 then Prime Minister Yoshiro Mori proposed to Putin during talks in Irkutsk that simultaneous negotiations be held on the reversion of the Habomai and Shikotan islands (whose return was promised in the 1956 declaration) and on the sovereignty of the Kunashiri and Etorofu islands.
Under the proposal, territorial negotiations would place emphasis on the sovereignty of Kunashiri and Etorofu while a special work group would be set up to discuss details of the return of Habomai and Shikotan.
It would be an illusion to expect that the agreement on the two-track talks would lead to some dramatic progress in negotiations on the peace treaty.

Furthermore, all of the navigable channels to the north are very narrow, and you might find that as you entered one of the straits, a comparatively small contingent of US ships could suddenly appear in the ocean ahead, blocking your route and placing you in a very compromised position.
Even if Kunashiri were a barren rock, and the sea around it completely devoid of fish, its strategic value to the Soviet Union, especially during the cold war, must be seen as enormous.
Thus, it is no surprise that most of the Cold War-era proposals from Japan in an attempt to start negotiations over the islands were based on a formula under which Japan would receive all islands EXCEPT Kunashiri in return for a formal peace treaty, and negotiations over Kunashiri would be put off "until relations stabilised".

Alexander's Gas & Oil Connections - Creative thinking on the Kuril Islands
But Tokyo should allow Russia to run the administration of Kunashiri in the near- and mid-term, permitting Russian residents to live on the island and waiting for some of them to move to Etorofu in the long term.
Another reason in support of this kind of solution is that since those smaller three islands -- Habomai, Shikotan and Kunashiri -- and the largest island -- Etorofu -- are administered by different local government organizations, it must be easier to redraw a national boundary between Kunashiri and Etorofu.
Specifically, Habomai, Shikotan and Kunashiri have been administrated by the "Southern Kuril" local government of the Sakhalin provincial government, while Etorofu has been under the administration of the "Kuril" local government of Russia's Sakhalin Island.

According to Bohlen, US President Franklin Roosevelt accepted Soviet proposals due to the fact that he “thought that both southern Sakhalin and the Kuriles had been seized by Japan in the 1904 war and that Russia was only getting back the territories that had been taken from her”.
As a legal pretext, Japanese protesters used the statement of the Allied powers confirmed during Potsdam conference according to which Japan was to be stripped of all the "territories which she has taken by violence and greed".
