Kwethluk IRA Council is the governing body for the Yup'ik Eskimos of the Native Village of Kwethluk which is located in the Lower Kuskokwim area of Southwest Alaska.
Morry and Kwethluk contend that the superior court drew the least intrusive standard from the overall structure and intent of the statute, from the judicial construction of the comparable provisions of ANILCA, and from analogous areas of law in which hunting and fishing rights are accorded a priority in law.
Morry and Kwethluk further argue that the reason why residents of one region could not travel to another region and engage in subsistence uses was not based on the character ("rural" or "urban") of their respective places.

The Kwethluk tribal judges do not handle felony cases, which are adjudicated by the state courts, but they do handle misdemeanors, DWIs, minors consuming alcohol or domestic violence and alcohol importation cases.
Andrew never expected to be elected by the Kwethluk IRA to be a tribal court judge in her village.

Tensions were high when Kwethluk won a federal court order in 1990 allowing villagers to hunt the small Kilbuck caribou herd, against the recommendations of state and federal biologists.
Kwethluk -- In 1990, when Yup'ik villagers along the Kuskokwim River were barred from hunting the small Kilbuck caribou herd, some hunters rode their snowmachines into the mountains and shot caribou anyway.
Kwethluk is a string of houses set on pilings along a mile of Kuskokwim riverbank upstream from Bethel.

A quarter of the district's teaching staff is Alaska Native — about 65 teachers — and half of them are instructional aides who assist elementary teachers (requiring some college coursework) or teach Yup'ik culture and language (requiring village recognition of one's expertise and nomination by the local school board).
While some Alaska colleges and universities offer distance-delivery courses leading to undergraduate degrees and teacher certification, an aide who is working full time in the classroom may need up to 10 to 15 years to complete her program.
Kwethluk teacher Beverly Chmielarczyk has made the village her home for several years, learning by living there to see where Native and Western knowledge intersect and how to infuse this into her instruction.

KWETHLUK, Alaska -- In the clearings along the broad Kuskokwim River where the Yup'ik Eskimos set up their fish camps, this is a busy time.
That law, Title VIII of the Alaska National Interest Lands Conservation Act, was passed by Congress in 1980, establishing a subsistence priority, loosely defined as applying to rural Alaskans and thus covering what it termed the "customary and traditional" uses of subsistence gatherers.
The state has been managing fishing on those lands and has asked to keep doing so while it tries to work out language to protect subsistence rights, but Babbitt said earlier this month that he was disappointed the Legislature had not brought the issue before voters and that it was time to act.
