LDDS asserts that United's actions amount to unjust and unreasonable practices in violation of Section 201(b) of the Act, and it seeks damages in the amount by which United retroactively increased its liability for intrastate access service.
LDDS argues that the back-billing of which it complains constituted a single, unified transaction to which the Commission's jurisdiction necessarily attaches in light of the involvement of United's federal tariff.
Thus LDDS contends that, given the reciprocal relationship between interstate and intrastate minutes of use, "any change to the intrastate PIU automatically affects change to the interstate PIU." It contends that, regardless of the terms of the intrastate tariff on the question, the interstate tariff prohibits back-billing.

In the overall retention measure, the Region's LDDs ranged from a low of a 35 percent five-year retention rate in AL 1H to a high of 63 percent in VA 12F.
The best LDD performances were among the largest classes of firms examined; nineteen LDDs (27 percent) demonstrated higher than average concentrations for firms which began with fewer than fifty employees and ended the period with more than one hundred.

The corporation was the result of the merger of WorldCom (formerly known as LDDS) and MCI Communications, and used the name MCI WorldCom followed by WorldCom before taking its final name on April 14, 2003 as part of the corporation's emergence from bankruptcy.
In 1985 LDDS selected Bernard Ebbers to be its CEO.
The company went public in August 1989 when it merged with Advantage Companies Inc. The company name was changed to LDDS WorldCom in 1995, and later just WorldCom.

At the first meeting in Washington, DC, the initial group of participants determined that the national LDD sector, with its hundreds of thousands of members, in collaboration with scientists and key environmental health and justice organizations, could be an effective voice for protecting children from toxic hazards related to brain development.
In addition, the group acknowledged that most learning and LDD groups have traditionally focused on identifying kids with LDDs and getting them the services they need – something that is, of course, very important but does not address the rising rates of LDDs.
For this reason, LDDI also coalesced to encourage the LDD sector to look collectively upstream, and in addition to their other efforts, help prevent toxic threats to child development.
