Johnson also provided an alibi witness who testified that the accused was visiting her at a distant location at the time of the robbery.
Johnson did not object to the denial ruling, submit a corrected version of the instruction, or ask the trial judge to redact the punishment portion of his proffered instruction.
Johnson alleges on appeal that the trial judge erred in refusing the instruction, despite its defective bifurcation language, because larceny from the person is a lesser-included offense of robbery.

 02-3214 -- Johnson v. Hemingway -- 02/14/2003
Petitioner-appellant Timothy Lamont Johnson seeks a certificate of appealability ("COA") pursuant to 28 U.S.C. § 2253(c) to challenge the district court's dismissal of his petition for a writ of habeas corpus for lack of jurisdiction.
The district court dismissed Johnson's petition because he was no longer in state custody as required by 28 U.S.C. We conclude that the district court lacked jurisdiction over Johnson's petition, deny a COA, and dismiss the appeal.
Although Johnson was no longer in state custody when his § 2254 petition was filed, he claimed that he could still attack the state conviction because it affected his current federal sentence.

Pianist Lamont Johnson is best-known for his work with altoist Jackie McLean in the mid- to late 1960s, but he has continued to grow and evolve ever since while retaining his advanced hard bop-based style.
Although all ten of the selections are his recent originals (and were therefore not actually played at Slugs), the style is generally very much in the hard bop/modal vein of the period; only the funky "Fang Dancer" is a bit of an exception.
