In Hess v West Bloomfield Township, 439 Mich 550 (1992), the Michigan Supreme Court had to determine whether riparian rights are “land” and the “use of land” as those terms are used in the enabling provision of the Township Rural Zoning Act (TRZA).
Most land bordering Michigan’s lakes and streams is zoned “single-family.” If a township enforces its zoning ordinance as it applies to single family land with riparian rights, “keyholing” or “funneling” of large numbers of people onto a waterbody through single-family zoned land, will be prohibited.
Each year the association erects a 20-boat marina for dockage of its members’ boats; the shore is used as a private beach for member families and guests; the single-family house is a clubhouse; the remainder of the lot is used for parking the cars of members and guests and as a children’s playground.

In this action to abate a public nuisance, plaintiff Gerrish Township asked the trial court to order defendant John F. Doering to remove the replacement deck he had constructed without a building permit in violation of the Gerrish Township Zoning Ordinance.
The parties stipulated that Doering "removed the sun deck built by his parents and constructed a new one in the same location." It is beyond dispute, then, that the nonconforming use the old deck represented was discontinued to an extent of more than 50% of its assessed valuation.
We conclude that Doering was not prejudiced by the Township’s failure to enforce the Township Zoning Ordinance against him.

Plaintiff Higgins Lake Property Owners Association is comprised of owners of lakefront property located in subdivisions on the shores of Higgins Lake in Lyons Township in Roscommon County.
Accordingly, we affirm the trial court' finding that the scope of the dedication permitted the installation of one nonexclusive dock at the end of each of the roads leading to the lake, and that the public was entitled to reasonable use of the water for boating, swimming, and fishing.
However, we reverse the portion of the trial court's order that determined that the erection of boat hoists and the shore activities were within the scope of the plat dedication because those findings were not supported by the record and were clearly erroneous.

was in Gladwin County (which I have) and he was laid to rest in the Highland Cemetery, Honored memeber of the Free Methodist Church, and moved to Gladwin County in 1898 from Midland and resided for 14 years as a Farmer.
The 1880 Michigan census shows that he was not living with his parents and may have moved to Gladwin County shortly after his marriage.
