Fabius' ouster showed how the Socialists, whom polls show still retain strong public support after huge victories in regional elections in 2004, are far from united ahead of the French presidential elections in two years.
Fabius, prime minister from 1984-86, said the charter was too market-oriented and would deprive France of coveted social protections, and said it needed to be changed.
Fabius was the standard-bearer of opposition within the party, whose leadership voted in December to support the treaty in an internal party vote.

Former French PM Fabius imposes conditions for supporting EU constitution - EUbusiness   (Site not responding. Last check: 2007-10-07)
Fabius, 58, said Chirac should ensure four changes before France's referendum is called on the constitutional treaty, which was drawn up under the guidance of former president Valery Giscard d'Estaing.
Fabius would also find himself in a useful alliance with the left wing of the party, which has until now criticised him for pursuing a market-oriented economic policy as finance minister in the late 1990s.
The risk of urging "no" is that Fabius would suffer a severe loss of credibility if a majority of party members voted in favour of the constitution at their consultation in November, commentators said.

At a party leadership conference, members voted to approve a new list of leaders that excluded Fabius and others who had urged a French "no" in the run-up to France's May 29 referendum on the charter, the result of which sparked a government shake-up last week.
Socialist lawmaker Jean-Luc Melenchon, who like Fabius opposed the constitution, called for the resignation of the entire party leadership — though he acknowledged that was unlikely.

However, Cimoszewicz is poles apart from former Socialist French prime minister Laurent Fabius, who has come out against the constitution, intensifying the split amongst the socialists.
In typical Gallic style, though, Fabius stopped short of calling for a "no" vote and settled for telling Chirac he would only support the deal if the president pushed through a series of amendments to compensate for what he calls the constitution's "grave shortcomings" – something which simply cannot happen.
According to AFP, Fabius wants "a new economic policy be put in place at the European level on the issue of employment" and a "fight against the outsourcing of jobs," both highly populist issues that will appeal to a broad spectrum of French society.

French Socialists in Crisis As Ex-pm is Ejected From Leadership
France's Socialists were in crisis yesterday after Laurent Fabius, the former prime minister, was unceremoniously ejected from the leadership for having broken the party line and championed the victorious no vote in last weekend's referendum on the EU constitution.
Mr Fabius, the Socialists' number two, and four of his chief lieutenants were ousted from the party's 20-strong national secretariat at a stormy six-hour meeting in a Paris hotel one week after 55% of French voters rejected the constitution, triggering a government reshuffle in France and plunging the union into disarray.
A stony-faced Mr Fabius said after the meeting on Saturday that he would "remain true" to his line by "listening to the the French people, trying to reunite the Socialist party and preparing for a victorious campaign" in the 2007 elections.
