India is a source, destination, and transit country for men, women, and children trafficked for the purposes of forced or bonded labor and commercial sexual exploitation.
India should consider designating and empowering a national law enforcement agency with investigative and prosecutorial jurisdiction throughout the country to address its interstate and international trafficking problem.
In addition, India should consider instituting a comprehensive database to compile state level statistics related to the rescue of victims of sex trafficking and forced or bonded labor, as well as the arrest and prosecution of their traffickers or exploiters.

Fears that a law with teeth could be used to chew on the rights of people has ensured that the home ministry is reluctant to give similar powers to other states; allegations of misuse of Pota are too recent to be forgotten by the ruling coalition that made its repeal an electoral plank.
He said the new law should have inbuilt provisions for a strong witness protection programme, special courts and enhanced sentence and should provide legal backing for action against support structures of organised crime like financiers and their contacts in the police and government.

 The Hindu : International : Law enforcement in India flawed: U.S. report
Although India is a "vibrant democracy" with strong Constitutionally guaranteed human rights protections, the poor enforcement of laws, especially at the local levels and the "severely out burdened" court system "weaken the delivery of justice," the State Department has said in its latest report, "Supporting human rights and democracy: The U.S. record 2004-2005."
In its observations on India, the report said the victory of the United Progressive Alliance over the incumbent Bharatiya Janata Party in the parliamentary elections of last year "verified" the ability of the people of India to change their government peacefully.
"Although the Government [of India] generally respected the human rights of its citizens, numerous problems remained," the report said and pointed to "shortcomings" such as extra-judicial killings, custodial deaths, excessive use of force by security forces, poor prison conditions and arbitrary arrests, and disappearances in combating insurgencies in Jammu and Kashmir.

Incidentally, although called ‘Hindu this-and-that laws’ these govern all Indians who are not Muslims, or Christians, and in that respect are more or less fairly common civil codes across all sects of Hindu community (even though their intent was to reform older Hindu laws and acts to bring them in line with civil code).
Hence codification of personal law as the first step, and that too at the initiative of the concerned community; i.e, the affected community has to ask for legislation; or as  S S Nigam had put it, “the respective areas in which religious influence is still strong have to be demarcated with sympathy, understanding and vision”.
