The Effect of Global Trade on United States Competition Law and Enforcement Policies - Pitofsky
Enforcement officials in many countries recognize that, in most matters, they cannot be effective on behalf of their consumers, nor fair to the business community, unless there are coordinated approaches, similar deadlines for review, and consistent remedies applied to particular transactions.
In the United States, claims of efficiencies could be offered as a relevant factor in the exercise of prosecutorial discretion by the Department of Justice or the Federal Trade Commission, but according to clear Supreme Court precedent, were not relevant when a transaction was examined in court.
Revised Merger Guidelines in the United States, and cases decided subsequent to publication of those Guidelines, require that the efficiencies are of a character and magnitude sufficient to reverse the merger's potential to harm consumers.

Orsay v. United States Department of Justice
The FTCA clearly provides that no action may be maintained against the United States for the torts of federal investigative or law enforcement officers unless the officers were acting within the scope of their employment at the time of the alleged torts.
Congress' decision to single out investigative and law enforcement officers from other federal employees reflects a concern that these officers, unlike other federal employees, are authorized to use force and threaten government action when necessary to carry out their investigative and law enforcement duties.
This language in the legislative history shows that Congress was focused on remedying "Federal law enforcement abuses," and lends support to a statutory construction that limits the government' s waiver of its immunity to intentional torts committed in the course of investigative or law enforcement activities.

Interestingly, there appear to be no federal statutes defining "martial law," so presumably we are left with its common law definition as control of a civilian population by military forces and the suspension of civil law in favor of direct military orders.
The clearest statement about martial law in federal law is in the Code of Federal Regulations, Title 32 (National Defense), Subtitle A (Department of Defense), Chapter V (Department of the Army), Subchapter A (Aid of Civil Authorities and Public Relations), Part 501 (Employment of Troops in Aid of Civil Authorities).
However, the decision to impose martial law may be made by the commander on the spot, if the circumstances demand immediate action, and time and available communications facilities do not permit obtaining prior approval from higher authority (§ 501.2).

SSRN-The Territoriality of United States Trademark Law by Graeme Austin
As commerce becomes progressively globalized, and communication networks enable firms to disseminate information about their trademarks more cheaply and efficiently, it becomes increasingly important for firms and their advisors to understand the geographical scope and limitations of legal rights attaching to trademarks.
Basic to trademark law, the territoriality principle characterizes trademark rights as owning their legal existence to the sovereign powers of individual nations.
Focusing primarily on U.S. law, this paper surveys the doctrine on the territoriality of trademarks in both domestic and cross-border contexts, and discusses two principal exceptions to territoriality: enforcement of trademark rights abroad under U.S. trademark law; and enforcement within the United States of trademark rights first established in foreign territories.
