However, the SGPA hasn't passed, and so therefore it is reasonable to assume that the UIGEA still encompasses games of skill until the courts say otherwise, even though the UIGEA is quite ambiguous on the matter..
On the one hand, it is always positive to see people outside the gaming establishment finally realize and accept that these virtual goods, be they land in Second Life or an Infinity Blade in World of Warcraft, do have a "value." Moreover, the idea of protecting players from theft is definitely a positive one.
Regardless of your stance on game regulation, the wisdom of self regulation is evident in many industries, from law to medicine.

Opponents declared the law a restriction on free speech and pointed out that similar laws had been struck down in other states.
The state also would have to show the law was the only way to achieve the state's goal and that it was as narrowly written as possible.

He said that games that are ultra-violent and were wrongly labeled by the industry as teen games, however, could be rated as "18" games under the law.
Basically, the video game industry can chose to be like the automobile industry, and embrace the regulation of their product when it comes to kids, or they can be like the tobacco industry and fight to sell their product to minors.

The State Senator is proposing legislation that would restrict the sale of video games to minors, despite the fact that there is questionable national legislation already pending (that's likely unconstitutional), and state attempts to pass such laws to date have been smashed by the judicial gavel.
There is no doubt that AO games fall into this category, and the definition of "violence" is so broad in the proposed legislation that it would include not only all of the M titles, but probably a portion of the T titles as well.
The legislation, as drafted, would also fail first amendment tests, because the legislation fails to consider the games as artistic works, which would mean that backers would have to prove in a court of law that such games are harmful to minors—something that no one has been able to prove before.

California is one of a string of states that recently have enacted similar laws restricting violent and sexually explicit video games--legislation that has been uniformly rejected by the courts.
Laws in Illinois and Michigan were blocked by federal judges on First Amendment grounds in the last few weeks, and earlier laws in Indianapolis and Missouri's St. Louis County have also been shot down.
The California law said minors must be restricted from buying a "violent video game." That was defined as a game in which the player has the option of "killing, maiming, dismembering or sexually assaulting an image of a human being" in offensive ways.

An odd set of legal rules stemming from patent law's effort to determine what constitutes willful infringement effectively requires companies confronted with a patent first to obtain a written opinion of counsel and then to disclose that opinion in court.
Even worse, the law puts the question whether an accused infringer will have to waive privilege in the hands of the patent owner, who can send a carefully crafted letter putting a potential defendant on notice of the patent.
In turn, accused infringers who are aware of these rules respond to such letters by obtaining a sort of pseudo-legal advice that both they and their attorneys recognize to be a construct.

The game definitely draws you along, You eagerly await the results of the tests you request, and wonder what the people you are talking to are hiding.
(in game time, not real time) It has a good storyline, suspicious, annoying, lying characters with secrets to protect, and it is fun to see what suspect you will interrogate next, what lab reports, research of items and people, the survailence unit to tail a suspect, the game is really fun.
This game would be very interesting and entertaining if they didn't cut off the investigation after a week (that's game time, not real time).

In addition to posing a massive threat to free speech, a law signed by the governor Oct. 7 sets a precedent in which government regulation, far from helping parents, gives them an easy way to shirk their obligations by paying less attention to what games their children are playing.
Worse, the law sets a precedent that puts government, not parents, in charge of determining what content is acceptable for children.
The law requires the labeling and restriction of games with violence that is "especially heinous, cruel or depraved." Clearly anticipating that this is an impossibly nebulous standard, the bill's authors further defined cruel, depraved, and heinous, but the results are still far from precise.

The statement goes on to emphasize that the games industry, via groups such as the ESA and the ESRB rating system, is effectively identifying mature-themed games and preventing their sale to minors.
The ESA points out that both the average game buyer and the average game player are adults, and that only 16% of games sold in 2004 were rated Mature.
Given gaming's diverse audience, the ESA feels games should not be treated more harshly than other media, such as movies or music.

A Michigan law barring the sale of violent video games to minors became the first of three recently passed measures to be set aside by a judge.
In a decision made Wednesday, the US District Court for the Eastern District of Michigan ruled that the Michigan law was not likely to pass constitutional muster, and that the law would cause "obvious harm" if it were allowed to go into effect on December 1 as mandated.
Rockstar was forced to withdraw the game from the market and release a decaffeinated version after the ESRB removed the game's M for Mature rating.

But there are some (or even all) games that kids can't buy in a shop on their own, and a bit of enforcement, so that the whining morons who try to ban stuff will shut their stupid holes.

SAN FRANCISCO (Reuters)—The video game industry on Monday vowed to challenge California Gov. Arnold Schwarzenegger in court to fight a new law banning the sale of violent video games to children.
The trade group Entertainment Software Association "intends to file a lawsuit to strike this law down and we are confident that we will prevail," President Douglas Lowenstein said in a statement on Monday.
The legislation bars the sale and rental to minors of games that show such things as the killing, maiming or sexual assault of a character depicted as human, and which are determined to be especially heinous, atrocious or cruel.
