  LEGAL SERVICES CORPORATION v
LSC's mission is to distribute funds appropriated by Congress to eligible local grantee organizations "for the purpose of providing financial support for legal assistance in noncriminal proceedings or matters to persons financially unable to afford legal assistance." ยง2996b(a).
As interpreted by the LSC and by the Government, the restriction prevents an attorney from arguing to a court that a state statute conflicts with a federal statute or that either a state or federal statute by its terms or in its application is violative of the United States Constitution.
Restricting LSC attorneys in advising their clients and in presenting arguments and analyses to the courts distorts the legal system by altering the traditional role of the attorneys in much the same way broadcast systems or student publication networks were changed in the limited forum cases we have cited.

The Corporation, formed in 1974 with bipartisan Congressional support and the endorsement of the Nixon Administration, was created to ensure that all Americans have access to a lawyer and the justice system for civil legal issues regardless of their ability to pay.
LSC opponents argued that the inaccuracies in the case service reporting were a deliberate attempt to mislead Congress.

The provision of civil legal services to the nation's poor through a comprehensive, national public-private partnership must be maintained and strengthened.
It is clear that LSC program grantees around the country are focusing on the priorities set by their local boards and adhering to the restrictions established by Congress in delivering basic legal services to low-income Americans.
Washington Legal Foundation, 524 U.S. 156 (1998), that, under Texas law, "the interest income generated by funds in IOLTA accounts is the private property of the owner of the principal." However, the Court expressly did not rule that IOLTA is an unconstitutional "taking" of client property.

Legal assistance was viewed as a form of charity, and clients deemed not to be among the "deserving poor" were turned away.
In 1980, supporters of legal services in Congress decided not to proceed with the final phases of legislation reauthorizing the program because of the number of amendments imposing new restrictions that were pending.
As new legal services resources were cultivated, LSC funding became an ever-smaller proportion of the overall resources that supported civil legal services in many areas of the country.

 LSC: America's Partner for Equal Justice
WASHINGTON, D.C. - Frank Strickland, Chairman of the Board of Directors of the Legal Services Corporation, testified yesterday in response to a question that LSC is adopting all 11 of the recommendations in the Inspector General's "Report on Certain Fiscal Practices at LSC," as indicated in LSC's response.
LSC has published its 2006 Income Guidelines, 45 CFR Part 1611, Appendix A. The 2006 guidelines are equivalent to 125% of the current Federal Poverty Guidelines as published by the Department of Health and Human Services on January 24, 2006 (71 FR 3848).
LSC President Helaine M. Barnett was invited as a guest of the Legal Aid Foundation of Taiwan to participate in their 2005 International Forum on Legal Aid in Taipei, Taiwan on October 15-17, 2005.

While it is a felony for a federal official to misappropriate federal funds, the LSC Act declares that "officers and employees of the Corporation shall not be considered officers and employees" of the federal government.

LSC has advised us, furthermore, that upon determining a question of statutory validity is present in any anticipated or pending case or controversy, the LSC-funded attorney must cease the representation at once.
The explicit premise for providing LSC attorneys is the necessity to make available representation “to persons financially unable to afford legal assistance.” There often will be no alternative source for the client to receive vital information respecting constitutional and statutory rights bearing upon claimed benefits.

NAIP was established in1986 to enhance legal services for the poor and the administration of justice through the growth and development of IOLTA programs as effective grant-making institutions that provide a major source of funding and support for legal services for the poor, administration of justice, and other law-related public interest programs.
Funding is primarily for operating grants for the provision of civil legal services to low-income Marylanders and for reduced-fee child custody representation.

The LSC is currently charged with funding and monitoring their Grantees, who provide free (actually greatly reduced cost) criminal and civil legal aid in the United States with a $300+ million budget.
Sitting judges in several states have acknowledged that the filing of false claims of domestic violence is both pervasive and that employees of LSC Grantees are among those scripting the statements of their clients in these cases.
In other cases where a client of an LSC Grantee has complained about one of their attorneys, they were assigned a different attorney who worked first to calm the client's complaint.

 Legal Services Corporation funding outrages
In an interview with Martha Bergmark, President of the Federal Legal Services Corporation --- which currently spends $283 million per year, I asked her about a case in Georgia where a Legal Services attorney had reportedly helped a transsexual sue the state health department to pay for a sex change operation.
She said, however, that many Legal Services cases do involve people trying to get what they are entitled to under many Federal programs, such as Social Security and Medicaid.
Legal Services President Martha Bergmark says, in The Washington Times (2/26/97): "Opponents of the Legal Services Corporation often distort wildly the facts of the case to further their cause...Legal Services lawyers do everything they can to give high-quality representation to clients that arise out of the everyday problems of the poor."

Intense congressional concern over the operations of the Legal Services Corporation is illustrated by the rider to appropriations bill H.R. 6957, restricting lobbying and other activities by Legal Services lawyers.
Should the Corporation have to function with a one-member Board of Directors, serious'oversight of the local programs and staff will be extremely difficult.

Our brief argued that the restriction intrudes directly into the manner in which lawyers represent their clients, imposing limits that are inconsistent with prevailing professional standards and impeding lawyers' ability to provide effective and zealous representation.

The Supreme Court heard oral argument in the case on October 4, 2000 and ruled in our favor in a 5-4 decision on February 28, 2001.
