LAWS governing occupational health and safety and criminal liability for mine managers should be overhauled to ensure more certainty for resource projects, the Prime Minister, John Howard, has urged.
The letter asks the premiers to agree that state and federal officials bring a proposal to the meeting "that would ensure that safety responsibilities are apportioned to all parties (organisations or individuals) to the extent that they have control and influence over the operation of the mine".
The act deems managers and directors personally liable for safety offences committed by companies unless they can prove they were not able to influence the company.
