The trail that led to Mr Kuvayev and his colleagues was followed through a series of websites which often changed address and were hosted on servers in several different countries.
The legal action was taken in Massachusetts because Mr Kuvayev has a home in the state and the companies operated by the seven defendants use a Boston-based PO box for correspondence.

Tom Reilly, Massachusetts attorney general, said the whereabouts of Kuvayev, who he considers the ringleader of the operation, are unknown, but they wanted to get the injunction and complaint filed and approved to shut down the operation immediately to protect Internet users.

Those subject lines are flags pointing to the Russian Spam Gang (aka Leo Kuvayev and Vladislav Khokholkov).
Back when they first started their affiliate spamming operation, those subject lines "Re [{number}]" was pretty much all they used.
Leo Kuvayev, a Moscow native who subsequently became a US citizen, ran back to Moscow after learning of the FBI investigation.
