Lincoln police arrested Levi, 69, of the 500 block of South Main Street following an incident in June 2003 when he allegedly attempted to run over Pedro Figueroa, 32, with his truck at a residence in the 1000 block of North Jefferson Street, where Figueroa and his wife, Lee, own rental property.
According to the most consistent testimony, Levi drove his pickup on or near the driveway of the Figueroa's rental property and stopped his truck six to 10 feet from and parallel to Lee Figueroa's car, where she was seated.
Levi testified that Lee Figueroa "gave him the finger" numerous times when they would see each other throughout Lincoln - and it was that gesture he was inquiring about the day before the more significant events occurred.

Levi Lincoln was born in Hingham, Massachusetts, on May 15, 1749, and graduated from Harvard University in 1772.
Following a brief stint as a minuteman in the Revolutionary Army (1776-1777), Lincoln held various legal titles in Massachusetts from 1777 to 1781, such as clerk of the court, judge of probate, and county prosecutor in Worcester County.
Lincoln served in that post until 1805 and also functioned as interim secretary of state for two months in 1801.

Prominent Worcester, Massachusetts, resident Waldo Lincoln became a member of the American Antiquarian Society in 1898, was elected vice president in 1906, and became president in 1907, a position he retained until his retirement in 1927.
Lincoln worked hard to give the Society financial security by establishing an endowment system; during his term as president, both the library's capacity and income doubled.
In 1923 Lincoln compiled the checklist 'Portraits in the Library of the American Antiquarian Society,' one of the Society's earliest records of the contents of the painting collection.(6) After his retirement from the presidency, Lincoln published his 'Bibliography of American Cookery Books 1742-1860' in the Proceedings in 1929, the same year this portrait was painted.
