The function of the lex talionis would have been initially to avoid an unregulated revenge but its primary role is support the victim’s family with a virtual compensation.
A group of scholars (from an anti‑abortion position), imposing their view of life (“a fetus is life”) on the text, applies the lex talionis specifically to a fetus: the harsh lex talionis should be effective with the death of a fetus because it is life.
This lex talionis in relation to the woman/miscarriage issue is well attested in the Hammurabi Code 196‑214 and Middle Assyrian Law 50 as well.

The term lex talionis does not always and only refer to literal eye-for-an-eye codes of justice (see rather mirror punishment) but applies to the broader class of legal systems that specify formulaic penalities for specific crimes, which are thought to be fitting in their severity.
Various ideas regarding the origins of lex talionis exist, but a common one is that it developed as early civilizations grew and a less well-established system for retribution of wrongs, feuds and vendettas, threatened the social fabric.
Despite having been replaced with newer modes of legal theory, lex talionis systems served a critical purpose in the development of social systems — the establishment of a body whose purpose was to enact the retaliation and ensure that this was the only punishment.

This is not to suggest that the lex talionis follows from the golden rule, but rather that the two share a common moral inspiration: the equality of persons.
The truth of the retributivist principle establishes the justice of the lex talionis, but, since it establishes this as a right of the victim rather than a duty, it does not settle the question of whether or to what extent the victim or the state should exercise this right and exact the lex talionis.
On the lex talionis, it would seem that such a criminal might justly be brought to within an inch of death and then revived (or to within a moment of execution and then reprieved) as many times as he has killed (minus one), and then finally executed.

Lex Talionis is the defense mechanism of healthy society since time immemorial.
Whatever else one may think of the State of Israel, it is the only one that continues to execute Lex Talionis both domestically and in its foreign relations: an enemy of Israel is not safe anywhere in the world.
It is time to return to the two laws of our forefathers: Eugenics, of which we have spoken in the past, and Lex Talionis, lest everything of value (and everyone) be engulfed by a sea of inferiority.

Hammurabi's code of laws is almost entirely based on the principle of equal and direct retribution; it betrays the origin of law in retributive violence.
Since the lex talionis is often the earliest form that law takes, from it we can conclude that the basic function of law is revenge and retribution.

Lex talionis, is it moral, is it something we can condone?
Before the mission of Jesus the law of the Old Testament was lex talionis, but Jesus fulfilled that law and instituted a higher law (we'll just call that law the Gospel of Jesus Christ).
In general it is thought there are two main moral systems in the Bible: the Law of Moses which was in effect pretty much from the early portions of the Old Testament until the mission of Jesus; and the Gospel of Jesus Christ.

The writing of Lex Talionis is unfortunately the weak point of this one-shot comic, as readers will quickly discover.
It doesn’t need to be set then to talk about Dian Fossey, after all, and none of the other elements of the story (the last I checked there were still poachers in Rwanda and most of the rest of Central Africa) would be absent if set in the present day.
Lex Talionis: A Jungle Tale might not be the best-written comic on sale by a wide margin, but it is simply beautiful.

Brad pointed out that there is not so much difficulty, if such Psalms are understood as an expression of lex talionis (retributory justice where an evil deed is rewarded in kind–the just God’s standard of justice).
I also think that even under the law, Israel in part understood that its relation to God was by grace (although the fully effectual means of this grace had yet to be revealed–the sacrificial system was symbolic of the need for grace and the granting of that grace to the penitent).
Jonah himself wasn’t happy that Nineveh escaped God’s lex talionis because it repented and relied upon God’s grace, but the theme is there whether Jonah liked it or not.

I've always known that Africa has this whole set of cultures, flora and fauna that are completely alien to me, things that I know largely from adventure fiction like Tarzan or the occasional travelogue.
Wright brings that exotic quality to life in Lex Talionis, showing a world where ruthless poachers hunt down innocent animals in what is perhaps the best example of man's greed and disregard for the larger natural world around him.
Lex Talionis is one of the most gorgeous books I've seen.
