However, Liberty stated that it did not disclose the receipt of the subpoena in its VENDEX questionnaires because it was told by an individual formerly associated with DOI, that Liberty was not under investigation and that the subpoena Liberty received was related to an investigation of the New York City Housing Authority ("NYCHA").
Liberty stated that this was not an "investigation for failure to pay prevailing wages, only a misclassification of employee titles," for which Liberty paid restitution in the amount of $17,856.
Liberty did not produce any written correspondence from DOI confirming that DOI specifically told Liberty that it was not involved in the investigation for which the subpoena was issued.

The tree was a rallying point for the growing resistance to the rule of England over the American colonies.
When the news of the Liberty Tree spread throughout the colonies, local patriots in each of the 13 colonies formed a Sons of Liberty group and identified a large tree to be used as a meeting place.
For many years the remnant of the tree was used as a reference point by local citizens, similar to the Boston Stone, and became known as the "Liberty Stump." Later the citizens in many of the colonies erected a Liberty Pole in commemoration of the Liberty Tree.
