King County Superior Court Judge William Downing ruled that Washington State must issue marriage licenses to same-sex couples -- even though Washington is one of 38 states with a state law defining marriage as the union of one man and one woman.
The state law "is not rationally related to any legitimate or compelling state interest," the judge said; and furthermore, he said there's no evidence that children are harmed when they are raised by same-sex couples.
Other states with marriage constitutional amendments on the ballot this year are Louisiana (Sept. 18); and Arkansas, Georgia, Kentucky, Mississippi, Montana, Oklahoma, and Utah (all on the November 2nd ballot).
