The case was based on a statement in the union’s statute that it would “defend the rights of individuals to education in their mother tongues” which the prosecuting authorities claimed was unconstitutional.
Positive measures introduced included: the abolition of the possibility that someone convicted of rape could have their sentence reduced, postponed or annulled if he agreed to marry the victim; the explicit recognition of marital rape as a crime; and the definition of sustained and systematic violence in the family as torture.
