If an entity distributes copies or derivative works of GPL licensed software without following the terms of the GPL, that may constitute copyright infringement, and the copyright holders of the GPL licensed software may be entitled to monetary damages, and can get a court to issue an injunction to stop further distribution of the software.
If someone releases code or a binary program that is a copy or a derivative work of GPL licensed software without licensing it under the GPL they could be sued for copyright infringement.

The "Program", below, refers to any such program or work, and a "work based on the Program" means either the Program or any derivative work under copyright law: that is to say, a work containing the Program or a portion of it, either verbatim or with modifications and/or translated into another language.
When a program or work is released under a license, this means that you are in effect licensed to use the program.

It is incompatible with the GPL because of the requirement to send a copy to the original maintainer if he or she asks for one, which is a requirement not in the GPL.

Posted: JAN 06, 2006 08:39:34 AM It is at the author’s sole discretion what license he/she releases code under: the mere existance of GPL 3 will have absolutely no impact whatsoever on code if the author of that code does not wish to use it.
The use of the GPL 3 should only scare you if you plan to profit from someone elses work and have no plans to give back to those who made it possible.
The GPL is not "viral" because its conditions only apply to code released under the GPL.
