Like all U.S. income tax conventions, this Convention provides rules specifying when income that arises in one of the countries and is derived by residents of the other country may be taxed by the country in which the income arises (the "source" country).
Such royalties may also be taxed in the Contracting State in which they arise and according to the laws of that State, but if the beneficial owner is a resident of the other Contracting State, the tax so charged shall not exceed 5 percent of the gross amount of the royalties.
A resident of a Contracting State that maintains one or several abodes in the other Contracting State shall not be subject in that other State to an income tax according to an "imputed income" based on the rental value of that or those abodes.

On May 26, 2005, Governor Robert L. Ehrlich, Jr., signed into law legislation enacted by the 2005 session of the General Assembly that discontinues the deduction of the Homestead Tax Credit from the maximum assessment eligible for Homeowners' Tax Credit consideration.
This change will increase the amount paid as credits to the affected homeowners by $1.5 million in the current 2005 Homeowners' Tax Credit application year.
Applicant homeowners will automatically receive the benefit of this law change without further action on their part.
