Garioch, pronounced "gayree", in the centre of the shire, comprises a beautiful, undulating, loamy, fertile valley.
This policy culminated in the invasion of Aberdeenshire by Donald, Lord of the Isles, who, however, suffered defeat at Harlaw, near Inverurie, at the hands of the earl of Mar in 1411.
Bitter feuds raged between these families for a long period, but the Gordons reached the height of their power in the first half of the 16th century, when their domains, already vast, were enhanced by the acquisition, through marriage, of the earldom of Sutherland (1514).

On the earl's death in 1435 the earldom was claimed by Robert, Lord Erskine, as heir of Gratney, earl of Mar, through a daughter; but the Crown claimed as reversionary under the xeation of 1426.
The House of Lords decided (Feb. 25, 1875) that Lord Kellie was entitled to the earldom as having been created by Queen Mary in 1565, with a limitation which must be presumed to be to heirs-male of the body.
A barony of Garioch is also wrongly said to be annexed to it, but the title is used by the earls eldest son in default of any other.

However, the Earl of Kellie submitted a petition to the House of Lords asking that the Earldom of Mar be declared his, dying before it could be considered.
The House of Lords Committee on Privileges ruled in 1875, to the dissatisfaction of many, that the Earldom of Mar was newly created in 1565, passed only to heirs-male, and therefore belonged to the Earl of Kellie, and not to Goodeve Erskine.
The Lord Chancellor, Roundell Palmer, 1st Baron Selborne, declared it to be "final, right or wrong, and not to be questioned".

 The Lordship of Garioch
A fairly substantial portion of Mar, the Garioch, about 200 square miles in the east of the territory, became identified separately, probably in the reign of Malcolm Canmore (mid-11th century), and was appropriated as an appanage of the Royal House.
At Thomas’s death Mar and Garioch passed to his sister Margaret and thence to her daughter, Isabel, who used the style Countess of Mar and Lady of Garioch.
A substantial amount, including the Lordship of Garioch, was acquired by William Duff of Dipple and Braco, and during the years that followed, the Duffs became the principal landowners in Aberdeenshire and, with their estates along the southern coast of the Moray Firth, one of the richest families in Scotland.

On the King and the lords returning from the chamber to the hall, Lord Erskine was called, and appeared in the presence of the King, bishops, barons, lords, and many free-holders of the Sheriffdom of Aberdeen and other Sheriffdoms.
Touching the second point of inquest, though Lord Erskine was the nearest and lawful heir of his father, yet this was never the case in regard to the lands in question.
