LORD PROSSER: If on behalf of accused persons the matter is raised, as this was at the end of the Defence case, and if the Sheriff is willing to tell them what her conclusion is on that, and if her conclusion is that acquittal is appropriate, does one really have to go...
LORD PROSSER: Well maybe I better look at this then, as a matter of analysis is she holding that a, as a matter of fact it was a threat and b, that threat was contrary to the international law and as a consequence of our own law.
DI ROLLO: It is an implied promise by a government of a resort to force conditional, it doesn’t have to be necessarily separated, and force is going to be the kind of force that is going to be used.

Nevertheless, he was greatly outnumbered by the Covenanters: Montrose's Highlanders and the Irish together made up no more than 2000 men, Lord Elcho on the other side had 7,000 infantry and 700 horse.
On the Covenanters' side, Lord Elcho commanded the right wing, James Murray of Gask the centre, and the left flank was given over to Sir James Scott of Rossie, the only veteran soldier present in the Covenant army that day.
Montrose put Lord Kilpoint and 400 archers on the left, directly in front of Elcho.

LORD PROSSER: That perhaps deals with the point I raised with you, you look at the requirement of international law in an armed conflict, but what they are saying is the threat or use of nuclear weapons as it were, whether or not in armed conflict should be compatible with those requirements.
LORD PROSSER: And of course it is a matter on which we have only heard the Crown approach to necessity at the moment, it might be much clearer after we have heard the Respondents and their approach to necessity, it might be much clearer how it will be handled.
LORD PROSSER: As soon as the questions have been referred and the Lord Advocate asks that they be answered in a given way then it is important that one has Respondents who may ask that they be answered in the opposite way, that seems to be close to a dispute.

The Rollo Clan Association Committee is concerned about posting the newsletters on the Internet, because the Newsletter is one of the services we provide for members in return for their subscriptions and if they were freely available on the net, then there would be less incentive for people to join us.
Lord Rollo died at the age of 81 after a long illness that he courageously bore.
Born on 3 December 1915, to the nephew of the then Lord Rollo (who had no male heir), from an early age he must have been aware of his inheritance.

Eric Rollo, the Dane, had obtained a settlement in Normandy so early as the eighth century, and from him were descended the Dukes of Normandy, in the line of whom, passing over several generations, we come to William the Conqueror, who became King of England in 1066.
Lord Rollo is a lateral descendant of Rollo the Dane, and of Rollo the first Duke of Normandy, through branches who came to England with William the Conqueror and to Scotland in the reign of David 1.

The third question referred to the House of Lords in that case was: "Does the defence of duress fail if the prosecution prove that a person of reasonable firmness sharing the characteristics of the defendant would not have given way to the threats as did the defendant?".
Lord Diplock at page 412 said that national security, the defence of the realm against enemies, is the responsibility of the executive, and not the courts of justice: "It is par excellence a non-justiciable question".
Lord Roskill at page 418 included the disposal of the armed forces among the prerogative powers which were not subject to judicial review.

'Rollo' is the name of the Viking chief who sailed up the Seine and made his capital in Rouen in what is now know as Normandy, which was eventually ceded to him by Charles the Simple.
His youngest son, Sir William Rollo was born lame in 1613, but became a Royalist soldier, one of the most devoted and trusted officers of the Marquis of Montrose.
Robert, 4th Lord Rollo (succeeded 1701) was one of the first nobles to rally to the 'Standard on the Braes o' Mar' in 1715.

It is perhaps indicative of the complex politics of Scotland at this time that William’s brother, James, second Lord Rollo, was married first to the sister of the Marquess of Montrose and then to the sister of his rival, the Marquess of Argyll.
John, eighth Lord Rollo, was an officer in the 3rd Regiment of Guards, and fought on the Continent between 1793 and 1795.
In June 1869 the tenth Lord Rollo was created Baron Dunning in the peerage of the United Kingdom, thereby securing, under the law at that time, a permanent seat in the House of Lords.

 [No title]
The logic of Mr Di Rollo's position leads him to conclude that that the use of an answer acquired under s 172 does impinge upon the right to a fair trial because, of course, in his view any restriction of the "fundamental" privilege against self incrimination is bound to have this effect.
Thus, Lord Hope (at p 79I) quite rightly castigated the ECHR for its "failure" to examine the essential issue, namely the appropriate balance to be drawn between individual rights and the public interest, in determining whether a restriction upon one of the rights implied by art 6 is justified.
Similarly, Lord Steyn opined (at p 73K-L): "In their impact on the citizen, the two techniques are not widely different", and thus he could see no reason for distinguishing them, as the High Court had done, in terms of their effect upon the applicant's rights under art 6.

Lord Russell's tolerance of competition to the established church had its limits, however: in 1850 he opposed reestablishment of Roman Catholic bishoprics in Britain.
Rollo and his mother, Countess Russell were members of the committee that founded the Unitarian Christian Church in Richmond in 1888.

Rollo converted to Catholicism, but the adoption of French culture and language did not immediately alter the social structure of the Norman lords.
To counter this nobility, the Norman lords made clergy, who were largely drawn from the nobility, as their vassals since the monastic and church lands were on lands owned by the duke.

The Lord Sheriff concluded that the threat and possession of Trident could be construed as a threat, and, as such, was an infringement of customary international law.
