  Lotus - LoveToKnow 1911
The lotus fruits of the Greeks belonged to Zizyphus Lotus, a bush native in south Europe with fruits as large as sloes, containing a mealy substance which can be used for making bread and also a fermented drink.
The lotus tree, known to the Romans as the Libyan lotus, and planted by them for shade, was probably Celtis australis, the nettle-tree, a southern European tree, a native of the elm family, with fruits like small cherries, which are first red and then fl.
Lotus of botanists is a genus of the pea-family (Leguminosae), containing a large number of species of herbs and undershrubs widely distributed in the temperate regions of the old world.

Lotus is also the name of a genus in the pea family, Leguminosae, which contains such plants as the bird's-foot trefoil, Lotus corniculatus.
Nymphaea lotus, the Egyptian white lotus, is believed to be the original sacred lotus of ancient Egypt.
The white lotus is a shallow-water, night-blooming plant with a creeping rootstock (rhizome) that sends up long-stalked, nearly circular, dark green leathery leaves, which float on the surface.

 LOTUS DEVELOPMENT CORP. v. BORLAND INTERNATIONAL INC., 49 F.3d 807 (1st Cir. 1995). (LOISLAW)
Lotus 1-2-3 utilizes a two-line menu; the top line lists the commands from which the user may choose, and the bottom line displays what Lotus calls its "long prompts." The long prompts explain, as a sort of "help text," what the highlighted menu command will do if entered.
As the Lotus long prompts are not before us on appeal, we take no position on their copyrightability, although we do note that a strong argument could be made that the brief explanations they provide "merge" with the underlying idea of explaining such functions.
Lotus has already reaped a substantial reward for being first; assuming that the Borland program is now better, good reasons exist for freeing it to attract old Lotus customers: to enable the old customers to take advantage of a new advance, and to reward Borland in turn for making a better product.

 Lotus v. Borland
Lotus filed this action against Borland in the District of Massachusetts on July 2, 1990, four days after a district court held that the Lotus 1-2-3 "menu structure, taken as a whole -- including the choice of command terms [and] the structure and order of those terms," was protected expression covered by Lotus's copyrights.
Lotus and Borland filed cross motions for summary judgment; the district court denied both motions on March 20, 1992, concluding that "neither party's motion is supported by the record." Borland I, 788 F.
If Lotus is granted a monopoly on this pattern, users who have learned the command structure of Lotus 1-2-3 or devised their own macros are locked into Lotus, just as a typist who has learned the QWERTY keyboard would be the captive of anyone who had a monopoly on the production of such a keyboard.

 LOTUS,
In Greek legend, the lotophagi (“lotus-eaters”), those who ate the fruit of the lotus tree, forgot their friends and homes and lost all desire to return to their native land.
Because the legends, as they have been passed down to the present, are inexact, it is not certain what plant may have been referred to, and several species have been suggested: Zizyphus lotus, a jujube; Celtis australis, a nettle tree; and Nitraria tridentata, a desert shrub—all of which are native to the Mediterranean region.
The seeds and rhizomes of this aquatic genus are edible, and its leaves are held above the water on long stalks.

Borland used the Lotus command hierarchy in its programs to allow compatibility with Lotus 1-2-3, so that users who were already familiar with Lotus 1-2-3 and had already learned its command procedures and had already written macros for that program, could switch to Borland without having to learn a new operating system.
Lotus filed this action against Borland in 2 July 1990 in the District of Massachusetts, four days after the District Court held that the Lotus 1-2-3 "menu structure, taken as a whole--including the choice of command terms [and] the structure and order of those terms" was protected expression covered by Lotus's copyrights.
Lotus did not cross-appeal; the issue being contested was Borland's copying of the Lotus menu tree into its Quattro programs and Borland's defenses to said coping.

 Lotus v. Borland
As explained above, the menu tree of Lotus 1-2-3 may be viewed as an arrangement of the executable operations as “leaves” of the “menu tree,” with internal commands (“branches”) leading through the structure to the “leaves.” Altogether, the tree contains 469 labels to explain the arrangement.
Lotus responds that Borland has not proved that copying of any part of the menu tree is necessary for running or translating macros.
Lotus explicitly stated that it doescontend that use of the Lotus menu structure to provide the ability to execute macros is impermissible, as done in Borland’s emulation interface.

Lotus 1-2-3 also allowed the user to write macros that automatically executed a series of desired menu commands (as well as other types of operations) when the user pressed a single keystroke combination.
In resolving this question in favor of Lotus, the district court concluded that there were numerous satisfactory ways for Borland to have named and organized its commands, other than to have copied from Lotus.
While in these "unchartered waters," the court accepted "the district court's finding that the Lotus developers made some expressive choices in choosing and arranging the Lotus Command terms." Nevertheless, the court did not follow the long line of cases which found copying of expression to constitute a key indication of actionable infringement.
