Lovell's decision came in response to two lawsuits that sought an order blocking use of the management plan until an environmental impact statement on its effects can be prepared.
Lovell agreed with government attorneys that the law allows the park to remove individual bison in order to protect and conserve the rest of the herd.
Lovell said the capture facility included in the plan would actually reduce the number of disease-free bison that would otherwise be routinely shot as they leave the park.

The park began to take shape in the early 1850’s when the village encircled it with a fence, graveled the walkways, and landscaped the grounds with trees, roses and shrubs.
Kalamazoo could truly boast possession of a park in its center when the village officially leased the land from the county in 1854, but it was not until February 1899 that the city passed Ordinance No. 172, officially naming it Bronson Park.
With the county courthouse to the north and city hall to the south, the park remains a "commons" in the center of the city.

Lovell summarily dismissed as a defendant the state Department of Fish, Wildlife and Parks by agreeing with gov ernment lawyers that the U.S. Constitution prohibits states from being sued in federal court.
Lovell said the state provided plenty of obvious, rational reasons for the law, including serving the public's desire to use waterways for recreation, promoting tourism and the economy, and managing Montana's natural resources and wildlife.
Lovell said the constitutionality of the stream access law was upheld in the state Supreme Court's decision 13 years ago and opponents did not appeal that loss to the U.S. Supreme Court, as was their option.

Lovell Park was one of the many business ventures initiated by the industrious Barker family who immigrated “out West” from Lovell Maine in 1854.
Robert C. Williams, curator and museum director of the Lovell Historical Society, was quite helpful tying together the Barker family connection between Cambria County and Lovell, Maine.
In 1841-2, Barker's brother-in-law, Obed Stearns of West Lovell, led a campaign in the Lovell congregational church (of which Barker was a member) to declare slavery a sin against God, denying "good standing" transfer of church membership to a former Lovell resident who had moved to Georgia and owned slaves.
