The plaintiffs, Mildred Jeter and Richard Loving, were residents of the Commonwealth of Virginia who had been married in June of 1958 in the District of Columbia, having left Virginia to evade a state law banning marriages between persons of different races.
Upon their return to Virginia, they were charged with violation of the ban, pled guilty, and were sentenced to one year in prison, with the sentence suspended for 25 years on condition that the couple leave the state of Virginia.

Richard and Mildred Loving were married in 1958 in Washington D.C. because their home state of Virginia still upheld the antimiscegenation law which stated that interracial marriages were illegal.
In March of 1966, the Virginia Supreme Court of Appeals upheld the law, but in June of 1967, the U.S. Supreme Court unanimously ruled the law unconstitutional.
Thus, in 1967 the 16 states which still had antimiscegenation laws on their books were forced to erase them.

At a time when many observers question whether America has made any real progress, on the racial front, it is worth recalling that as late as 1967, sixteen states prohibited people from marrying across racial frontiers.
The judge also lectured them on the importance and justifiabilty of the state's policy, asserting that the fact that "Almighty God" had initially placed the races on different continents "shows that he did not intend for the races to mix." One is tempted to laugh at the judge.
