Macrovision is a nuisance to some people because it can interfere with other electronic equipment.
It is the position of film and television studios that Macrovision is necessary to prevent piracy and that they are fully within their rights to add a block to someone exercising their fair use rights.
It is also the position of these studios that one does not have any right to copy their own videos, and they have attempted to lead the courts to rule the same.

Although Macrovision video copy protection has existed for nearly 15 years, it wasn't until the recent acceptance of DVD in mainstream consumer markets that its existence was felt at all.
Macrovision copy protection works by adding certain codes to these control lines that are interpreted by an Automatic Gain Control chip in a VCR to scramble the video signal if the video is being recorded.

A simple macrovision remover can be built quite easily from parts and schematics from the internet (I have on my server) or bought, often labeled 'video restorers' or similar to avoid legal problems.

The U.S. Patent and Trademark Office ruled in favor of InterTrust last Monday in a patent interference proceeding between it and Macrovision, thereby maintaining the status quo in DRM patent primacy.
An interference proceeding is an investigation of two patents with similar claims that were filed around the same time, on the basis that the differences in filing dates may have reflected administrative processes and therefore may not accurately represent which party actually invented first.

As someone mentioned, Macrovision is licensed to change the signal coming out of DVD players (and Satellite receivers also, in soem cases) to "prevent the signal from being recorded".
The only reason Macrovision keep sueing the providers of these "video enhancer" boxes is because they themselves hold patents on methods of stripping the macrovision disruption from the video stream...

I think that must be a fluke...the hardcoded macrovision in the card doesn't care whether the source material is macrovision protected or not, it simply uses macrovision on everything that goes through the tv-out.
I'm not saying that your perception of the macrovision is wrong, and i'm sure you know what you are talking about, but surely I can say that the macrovision kicks in on my system only when the software player tells it to kick in.
