A three-judge Constitutional bench of the Supreme Court directed that a new Madras high court judge should hear the Tansi land case against Tamil Nadu Chief Minister J Jayalalithaa.
Madras high court Justice Balasubramaniam was hearing the Tansi land case, before the Supreme Court stayed the proceedings last week.
The Supreme Court also directed the registrar of the Madras high court to give all documents of the Tansi case to the petitioner, K V Venkatapathy.

Chennai: The Madras High Court today (April 4, 2005) stayed an order holding that termination of tender proceedings for telecasting international cricket matches by the Board of Control fore Cricket in India (BCCI) was 'improper' and indicting former Board chief Jagmohan Dalmiya, while Zee Telefilms filed an appeal in the court challenging the order.
On March 21 justice K P Sivasubramanian giving his ruling on a petition by Zee, challenging the termination of the tender proceedings, had held that the BCCI action was "unjust, illegal and the result of bias against the petitioner (Zee telefilms)".
The observation involved grave consequences and accused Dalmiya of wrongful conduct merely on the basis of the affidavit filed by Zee Telefilms Ltd that had challenged the termination of the tender process in the High Court, the appeals said.

On the heels of burning the effigy of the chief justice within the high court premises yesterday for which four lawyers were arrested, some advocates met in Chennai early today to condemn the arrests.

The court can dismiss the appeal summarily (that is informally without a detailed hearing) if it considers that there is no sufficient ground for interfering but before dismissing the appeal summarily, the appellant or his Advocate has to be given a reasonable opportunity to present their case before the court.
The High court is required to give reasons for dismissing the appeal and the power to dismiss the appeal summarily has to be used sparingly.
Where an appeal by a convicted person is pending before the court, the court may by reasons to be recorded by it in writing, suspend the sentence passed against the convict and if the convict is in confinement grant him bail.

The Madras High Court has, in an interim injunction, restrained P T Ummer Koya and Sowmen Majumdar from acting as Secretary and Treasurer of the All India Chess Federation (AICF).
Copies of the court decision had been conveyed to the AICF President N Srinivasan, they said, adding that they hoped the AICF President would immediately appoint a new Secretary and Treasurer of the AICF, so that day-to-day functioning of the game was not affected and to ensure that the schedule of tournaments be adhered to.
Though the AICF was registered in Madras 1958, Koya had sought to conceal this and registered the organisation afresh at Kozhikode in 1991 as a new entity, Manuel Aaron said, adding that his signature had been forged in the registration documents.

NEW DELHI, Feb 18 (PTI) — Tamil Nadu today filed a writ petition in the Supreme Court challenging the validity of the Centre’s recent notification on the transfer of cases against AIADMK leader Jayalalitha in the Supreme Court, saying it had not been approved by the Madras High Court.
The Supreme Court is at present dealing with her appeal against the high court order.
However, counsel for Tamil Nadu contended that they wished to challenge the notification which did not have the consent of the Madras High Court and was not applicable to the cases of Jayalalitha which were already pending before the three special judges.
