Misfeasance, malfeasance, and nonfeasance - Wikipedia, the free encyclopedia
The expressions misfeasance and nonfeasance, and occasionally malfeasance, are used in English law with reference to the discharge of public obligations existing by common law, custom or statute.
Misfeasance is also used with reference to the conduct of directors and officers of joint-stock companies.
The word malfeasance is sometimes used as equivalent to mala praxis by a medical practitioner.

 Making the Malfeasance Case
Malfeasance is a fancy word for wrongdoing or misconduct in office.
According to Utah State Statute 77-6-1, any officer or justice of the peace not liable to impeachment can be removed for high crimes, misdemeanors, or malfeasance.
Unlike just about every other judicial proceeding in today's corrupted legal system, the malfeasance accusation must be written "in ordinary and concise language" (see statute 77-6-3).

If police malfeasance is to be reduced, the means of expressing these failings, which constantly change, require careful monitoring.
The challenge to law enforcement leaders is to be ever mindful of their departments' high visibility and to take all necessary measures to improve not just the image of policing, but also the practice.

Malfeasance is distinguished from "misfeasance," which is committing a wrong or error by mistake, negligence or inadvertence, but not by intentional wrongdoing.
Example: a city manager putting his indigent cousin on the city payroll at a wage the manager knows is above that allowed and/or letting him file false time cards is malfeasance; putting his able cousin on the payroll which, unknown to him, is a violation of an anti-nepotism statute is misfeasance.
This distinction can apply to corporate officers, public officials, trustees and others cloaked with responsibility.

One of the main reasons why individuals and unincorporated associations do incorporate is to gain some measure of insulation from the claims of third persons, whether under contract law or under a tort theory such as for negligence or fraud.
However, those who wield executive power in a corporation would do well to remember that despite the limited liability protections of incorporation, officers and directors can nevertheless expose themselves to personal liability if they commit malfeasance or fraud in acting of behalf of the corporation.
We will represent persons injured by the fraudulent conduct of corporate agents, and we will represent officers and directors accused of wrongdoing if they are uninsured.

GAO examined (1) State's internal controls to prevent nonimmigrant visa malfeasance and if they are being implemented and (2) visa malfeasance cases from 2001-2004 and factors cited by State and the Department of Justice (Justice) that contributed to visa malfeasance and affected investigations and prosecutions.
State has a set of internal controls to prevent visa malfeasance and has taken actions to improve them; however, these internal controls are not being fully and consistently implemented by the posts we visited.
In fact, their case records did not permit investigators to identify malfeasance trends or consular managers to identify internal control weaknesses needing attention.
