Smeaton could not have possibly had a fling with Anne on May 13, 1535, at Greenwich, as the queen was at Richmond.
Smeaton was condemned to death on 12th May 1536, as were the four other men accused of being the Queen's lovers.
Smeaton's body was buried in a common grave with another accused adulterer with the queen, William Brereton.

In May, 1536, Anne was accused of having used witchcraft to trap Henry into marriage and to entice five men to enter into adulterous affairs with her; being a whore; of creating competition and jealousy between the five; of afflicting the king with bodily harm; and of conspiring to effect his death - treason.
She is rumoured to have written a letter to her husband remonstrating against this "unworthy stain" on her reputation, and pleading with him to spare the five men accused with her and to remember their daughter Elizabeth.
On the evidence of Smeaton's false confessions, almost certainly obtained by torture, Anne was convicted at her trial on May 15.

On the 12th Sir Francis Weston, Henry Norris, William Brereton and Mark Smeaton were declared guilty of high treason, while Anne herself and Lord Rochford were condemned unanimously by an assembly of twenty-six peers on the 15th.
Her uncle, the Duke of Norfolk, presided as Lord Steward, and gave sentence, weeping, that his niece was to be burned or beheaded as pleased the king.
Smeaton alone of her supposed lovers made a full confession, and it is possible that his statement was drawn from him by threats of torture or hopes of pardon.
