Marinduque says Placer Dome pulled out when the mine was shut down shorter after the drainage tunnel disaster left the island in a nationally-declared state of calamity.
In the lawsuit, Marinduque seeks an undetermined amount for: repairing and reinforcing deteriorating mine structures representing imminent threats of repeated disasters; cleaning up and rehabilitating already polluted lands, rivers and coastal shores and bays; compensating economic losses including destroyed property, diminished livelihood and related expenses; and payment for lost lives and ongoing health problems.
Representing Marinduque in the lawsuit is a team of lawyers spearheaded by Diamond McCarthy Taylor Finley and Lee, LLP, a Texas-based litigation boutique, and Snell and Wilmer, LLP, a Phoenix, Arizona-based firm.

Roland Zosa, a development bank executive who is now president of Nonoc Mining, said Marinduque's copper mining operation and the company's cement plant, which were also acquired by the two banks in a recent mortgage foreclosure, soon will be made into separate companies to be owned jointly by the banks.
Marinduque's nickel mine has an estimated daily output of 10,000 dry tons of ore per day, while the daily output of the copper mine is said to be 40,000 metric tons of ore.

Three years of hardship have initiated residents of the municipality of Boac into a wretched fellowship with residents of the neighboring municipalities of Mogpog and Santa Cruz, where 30 years of irresponsible mining under the management of Canadian mining giant Placer Dome have left a legacy of environmental contamination, loss of livelihood, and health concerns.
Although it held only 40 percent of Marcopper shares, it was responsible for the day-to-day and technical operations of the company's mines; in exchange for securing and guaranteeing the loans needed to finance these mines, Placer Dome had been guaranteed the two top management positions.
One probable reason why STD is being pushed by Placer Dome in Marinduque is because the method is relatively among the cheapest to do.

While Placer Dome has quietly negotiated for years with Reyes and other officials concerning a settlement regarding the Marcopper tailings spill, Reyes chose to sue Placer in a Clark County state court in Las Vegas, in southern Nevada, despite the fact most mining cases are usually filed in northern Nevada courtrooms.
The litigation concludes by asking the Nevada lower court to order Vancouver, BC-based Placer Dome to complete the environmental clean-up of the affected areas of Marinduque in the Philippines, and also to order Placer Dome to create and adequately fund environmental and medical monitoring funds in the Philippines.
