Robert of Berkeley, the eldest son of Maurice, paid in 1190 the vast sum of iooo for livery of his great inheritance, but, rising with the rebellious barons against King John, his castle was taken into the kings hands.
Froissart errs in describing this knight as Thomas, lord of Berkeley, for the covenant made in 1360 for the release of Maurice is still among the Berkeley muniments, the ransom being stated at ~io8o.
The victorious Lord Berkeley, whose children died young, was on ifl terms with his next brother, and made havoc of the great Berkeley estates by grants to the Crown and the royal house, for which he was rewarded with certain empty titles.

Sir Maurice Berkeley of Bruton, a cadet of Stoke Giffard, was forefather of the Viscounts Fitzhardinge, the Lords Berkeley of Stratton (1658-1773) and the earls of Falmouth, all extinct, the Berkeleys of Stratton bequeathing their great London estate, including Berkeley Square and Stratton Street, to the main line.
Edward Berkeley of Pylle in Somerset, head of a cadet line of the Bruton family, married Phulippa Speke, whose mother was Joan, daughter of Sir John Portman of Orchard Portman, baronet.

It was first granted to Sir Thomas de Berkeley in 1295, but the title of that creation became extinct at the death of the fifth Baron, when no heirs to the barony remained.
His successor William was created Viscount Berkeley in 1481, Earl of Nottingham in 1483, and Marquess of Berkeley in 1488, all of which became extinct at his death.
The Earldom of Berkeley, togehter with the Viscountcy Dursley, was separated from the barony in 1882, but the accession was not fully established.

In 1571 overtures were made to lord and lady Berkeley by the Earls of Leicester and Warwick for the marriage of their nephews, Sir Phillip Sidney and Sir Robert Sidney, to lord Berkeley's two daughters Mary and Frances, but the proposals were declined by lady Berkeley, by which great offence was given.

According to the Berkeley family pedigree obtained at Berkeley Castle, he was the 11th Baron by tenure and the 1st Baron by Writ, 1394-1463.
He left Berkeley Castle and its estates to the crown for 'entail male', which meant that only with the extinction of the Royal male line on the death of King Edward VI did the Castle revert once more to the Berkeley line.
In these litigations he was generally successful, the late Marquess, in his anxiety to barter his lands for honours and patronage, having often overlooked the nature of the titles by which he held them.
