The constitution was adopted in 1780 and is the oldest functioning written constitution in the world.
It is the duty of the people, therefore, in framing a constitution of government, to provide for an equitable mode of making laws, as well as for an impartial interpretation, and a faithful execution of them; that every man may, at all times, find his security in them.

But, as matter of constitutional law, neither the mantra of tradition, nor individual conviction, can justify the perpetuation of a hierarchy in which couples of the same sex and their families are deemed less worthy of social and legal recognition than couples of the opposite sex and their families.

Massachusetts is the fourth U.S. state to have a high court rule in favor of legal marriage for same-sex couples.
The Massachusetts trial court had ruled against the seven same-sex couples on May 2002, concluding that having and raising children is central to the purpose of marriage, despite acknowledging that four of the seven couples in the case have children, and that Massachusetts law allows same-sex couples to jointly adopt.
Massachusetts licensing officers may require an affidavit declaring that marriage is not prohibited by the state laws where the couple resides.
