Fraser was then informed that he would be suspended for three days, and that his name would be removed from the list of candidates for graduation speaker at the school's commencement exercises.
The schools, as instruments of the state, may determine that the essential lessons of civil, mature conduct cannot be conveyed in a school that tolerates lewd, indecent, or offensive speech and conduct such as that indulged in by this confused boy.

It is argued that law enforcement officers searched a vehicle operated by the defendant, Matthew Fraser, after said vehicle attempted to outrun the police and both of the defendants and two accomplices fled the vehicle and abandoned it.
At the time that the car was abandoned, Matthew Fraser was apprehended by law enforcement officers for the second time in a period of approximately five hours for fleeing after abandoning a motor vehicle.
When the Frasers' were seen in a vehicle by law enforcement officers and subsequently attempted to flee from the law enforcement officers, they were within a block of the scene of the burglary.

On the day of the assembly, Fraser delivered the speech with enthusiasm and emphasis, and the "faculty and student body were stunned." The speech was greeted by his classmates with hoots, cheers, and lewd motions.
Fraser was suspended from school for three days, and "removed from the list of students who were eligible to make graduation remarks..." because school authorities "no longer had confidence in his judgement...." He ranked second in his graduating class at the time.
Fraser was not punished for the political nature of his speech, but rather for its sexual innuendo and obscenity.

The Supreme Court's Fraser decision held that a student could be disciplined for delivering a speech containing sexual innuendoes, even though the speech included no offensive language, was clearly not obscene in a legal sense, and was given in a campus political context (i.e., to nominate another student for an elective student government position).
However, the school principal was not amused: he suspended Fraser for two days and removed his name from a list of candidates in a student election to choose a graduation speaker.
Fraser won the graduation speaker election on a write-in vote and school officials permitted him to speak at his graduation--but only after he filed the lawsuit that led to the Supreme Court decision.
