McKittrick claimed that because there had been lone wolf sightings in the area before the wolves were brought from Canada to the Yellowstone region, the new population was not "wholly separate" from an existing population.
McKittrick reasons that because experimental populations are given the same level of ESA protection as threatened species, the Secretary's failure to recite the words "necessary and advisable" in the special rules applicable to the gray wolf experimental population is fatal to those regulations.
McKittrick argues that a violation of ESA section 11 requires the government to prove that he knew he was shooting a wolf, and that the jury instructions misled the jury about the requisite intent.

Although the La Brea Tar Pits are better known, the tar pits at McKittrick, on the westside of the San Joaquin Valley, contain an equally rich assemblage of ancient plants and animals that were trapped in asphalt pits and preserved as fossils.
Some of the McKittrick fossils can be seen at the Kern County Museum in Bakersfield, the West Kern Oil Museum in Taft, and the George C. Page Museum in Los Angeles.
The McKittrick Tar Pits sit on the westside of the San Joaquin Valley where stream gravels, alluvial sands, and lacustrine clays cover older marine rocks that are rich in oil.

Legend has it that immigrants traveling across California in 1849 used oil from natural seeps to grease their wagon wheels.
This mine shaft in the McKittrick asphaltum mine, Kern County, was built in the1860's with redwood timbers.
According to some reports, a single column of pure asphaltum 10 feet high and 6 feet in diameter was mined from a similar shaft in the McKittrick area.

This paper investigates the remarkable preservation of exoskeleton remains that are found at the Rancho La Brea and McKittrick sites, by determining the decay resistance of the cuticles from fossilised beetles and crickets found at the sites.
The analysis was carried out using the above fossilised material and also the fresh and decayed cuticles of modern beetles and crickets, in order to compare like with like (same state of decay in fossils for the same state of decay in the modern specimens).
